JOINT OWNERSHIP OF AQUIRED PROPERTY

Joint ownership of acquired property is the normal matrimonial property arrangement.

This comes into effect at the time of the marriage unless a marital agreement is concluded. Well over 90% of married couples in Switzerland have this arrangement. Each of the spouses manages and uses their own assets. However, each of them may transfer management of these assets to the other spouse, in whole or in part, issuing the other spouse with power of attorney for this purpose. Each spouse is solely liable for his or her own debts; a spouse does not have to accept responsibility for the other spouse's debts unless he or she is a contractual partner (joint liability) or the debts have been incurred due to household expenditure (household debts).
